New CA law helps pardon criminals facing deportation threats

California government is pushing a new state law that will offer an express review for criminals facing deportation. The state court system is continually backed up with cases requiring review. However, the purpose of this law is to grant higher priority reviews for criminals who are in jeopardy of losing their ability to stay in the United States.

In the past, the state has not been held to a time restriction for reviewing cases. This law will expedite the process for many individuals and families who are waiting to find out whether deportation will be enforced or not.

Requesting a pardon

If you or your loved one is convicted of a crime, they may be eligible to seek a pardon from the court. This depends on behavior and other criteria that is met to stay in compliance with the law. A pardon is not to be confused with eliminating conviction of a crime. Criminal charges may continue while a formal pardon allows for the reinstatement of certain rights to the individual.

Challenging deportation

A pardon can help stop a deportation order in its tracks. It might even cause the case to be re-opened and freshly evaluated. When this occurs, it offers a strong chance to the person facing deportation that their case will change directions. Challenging a deportation is possible, and with this new law, many people have hope.

If you or a loved one is struggling with immigration and criminal charges, seek high quality legal resources to help you navigate your pending options. You need to know what your legal rights are right away. The laws are continually being challenged and changed in ways that could help or hinder your intended outcome.
